1. Parties

1.2. Member
The natural or legal person who fills out the membership form on the Site and accepts this agreement.
2. Subject of the Agreement
This agreement aims to determine the rights and obligations of persons who become members of the yatveteknem.com website.
3. Membership Conditions
3.1. General Conditions
You must be at least 18 years of age to become a member.
All information provided in the membership application must be accurate, up-to-date, and complete.
Each person may create only one membership account.
Membership accounts are personal and non-transferable.
3.2. Account Security
The Member is personally responsible for the confidentiality of their account credentials (email and password).
The Member is responsible for all transactions carried out through their account.
The Member is obligated to immediately notify Yat ve Teknem upon discovering any unauthorized use of their account.
4. Rights and Obligations of the Service Provider
4.1. Rights
Yat ve Teknem has the right to change the services, content, and membership conditions on the Site without prior notice.
Yat ve Teknem has the right to temporarily or permanently suspend or terminate the account of a Member who violates this agreement.
Yat ve Teknem may temporarily or permanently discontinue any service on the Site.
4.2. Obligations
Yat ve Teknem shall exercise due diligence to provide services on the Site at the best possible quality.
Yat ve Teknem shall protect members' personal data in accordance with the KVKK and related legislation.
Yat ve Teknem shall make reasonable efforts to resolve technical issues.
5. Rights and Obligations of the Member
5.1. Rights
The Member has the right to benefit from the services on the Site within the scope of this agreement and applicable legislation.
The Member has the right to terminate their membership at any time.
The Member may exercise their rights under the KVKK regarding their personal data.
5.2. Obligations
The Member is obligated to comply with the following rules in their activities on the Site:
Act in accordance with the laws of the Republic of Turkey and international legislation
Keep membership information accurate and up-to-date
Respect the rights of other members
Avoid actions that may damage the Site infrastructure
Not infringe intellectual property rights
Not share false, misleading information, listings, or content
6. Rules Regarding Rental Services
6.1. Renter (Guest) Members
Obligated to provide accurate and complete information in rental requests.
Obligated to take care of the boat/yacht and its equipment during the rental period.
Obligated to comply with safety instructions.
6.2. Boat Owner Members
Responsible for the accuracy of information regarding their listed boat/yacht.
Obligated to ensure the boat/yacht is safe, clean, and in condition consistent with the listing.
Obligated to comply with legal regulations (license, insurance, etc.).
7. Pricing and Commission
Yat ve Teknem may charge a service commission on rental transactions carried out through the Site.
Commission rates and payment conditions are specified on the relevant service page or in separate agreements with the Member.
Payment conditions are explained in detail on the Distance Sales Agreement and Payment Options pages.
8. Intellectual Property
All content on the Site (text, images, logos, designs, software, etc.) belongs to or is licensed by Yat ve Teknem. The Member may not use, copy, or distribute this content without permission.
Content shared by the Member on the Site (photos, descriptions, etc.) is deemed to have been licensed to Yat ve Teknem for use within the scope of the Site.
9. Limitation of Liability
Yat ve Teknem does not guarantee uninterrupted operation of the Site.
Yat ve Teknem is not directly responsible for disputes between members; however, it may mediate in the resolution process.
In cases of force majeure (natural disaster, epidemic, war, legal regulation, etc.), the obligations of Yat ve Teknem shall be suspended.
10. Termination of Membership
10.1. By the Member
The Member may terminate their membership through account settings or by written application. If there are ongoing reservations or obligations, the relevant provisions shall remain in effect until they are completed.
10.2. By Yat ve Teknem
Yat ve Teknem may terminate membership without prior notice due to breach of agreement, unlawful activity, or other justified reasons.
11. Dispute Resolution
The laws of the Republic of Turkey shall apply to disputes arising from this agreement. Turkish courts and enforcement offices shall have jurisdiction.
12. Effective Date
This agreement takes effect on the date it is approved electronically by the Member.
