2. Subject of the Agreement
The subject of this agreement is the determination of the rights and obligations of the parties regarding the sale and performance of boat/yacht rental services, the characteristics of which are described in the agreement and the sales price of which is specified, ordered electronically by the Buyer through the yatveteknem.com website owned by the Seller, in accordance with the Consumer Protection Law No. 6502 and the Distance Contracts Regulation.
3. Service Information
3.1. Essential Characteristics of the Service
The type, name, duration, capacity, and sales price including all taxes of the service are specified on the order confirmation page and in the email sent after payment.
3.2. Payment Method and Plan
Payment is made via credit card, debit card, or other payment methods offered on yatveteknem.com. Payment conditions are clearly communicated to the Buyer on the service detail page and during the payment step.
3.3. Service Fee
The service fee is the amount shown on the order summary page, inclusive of all taxes.
4. General Provisions
4.1. The Buyer acknowledges and declares that they have read the preliminary information regarding the service (essential characteristics, price, payment method, etc.) on the yatveteknem.com website and have given the necessary consent electronically.
4.2. The Seller is responsible for the proper, complete, and order-compliant performance of the service.
4.3. If performance of the service becomes impossible and the Seller is unable to fulfill contractual obligations, the Seller shall notify the Buyer in writing within 3 (three) business days and refund the total amount within 14 (fourteen) days.
4.4. For the performance of the service, this agreement must be approved electronically and the service fee must be paid through the Buyer's preferred payment method.
5. Rights and Obligations of the Buyer
5.1. By completing the order and payment, the Buyer is deemed to have accepted the provisions of this agreement.
5.2. The Buyer is obligated to act in accordance with the nature of the service, terms of use, and safety instructions.
5.3. The Buyer is obligated to comply with the dates and times specified during reservation. The Seller shall not be held responsible for delays or cancellations caused by the Buyer's fault.
5.4. The Buyer is obligated not to damage the boat/yacht and its equipment during the service. The Buyer is responsible for any damages incurred.
6. Rights and Obligations of the Seller
6.1. The Seller is obligated to perform the service completely, in accordance with the order details, and together with any warranty documents if applicable.
6.2. In the event that the service cannot be performed due to weather conditions, natural disasters, technical failures, or force majeure, the Seller shall immediately inform the Buyer and refund the paid amount within 14 (fourteen) days, or offer an alternative date/service with the Buyer's approval.
6.3. The Seller is obligated to protect the Buyer's personal data in accordance with the Personal Data Protection Law No. 6698 and related legislation.
7. Right of Withdrawal
7.1. Exercise of the Right of Withdrawal
The Buyer has the right to withdraw from the agreement within 14 (fourteen) days before the service performance begins, without stating any reason and without paying any penalty. The withdrawal period begins from the date of purchase.
7.2. Method of Exercising Withdrawal
To exercise the right of withdrawal, it is sufficient to notify the Seller in writing (via email or postal mail) within the 14 (fourteen) day period.
7.3. Cases Where the Right of Withdrawal Cannot Be Exercised
Pursuant to Article 15 of Law No. 6502 and Article 15 of the Distance Contracts Regulation, the Buyer cannot exercise the right of withdrawal in the following cases:
In contracts for accommodation, transportation of goods, car rental, food-beverage supply, and services for entertainment or leisure purposes that must be performed on a specific date or period, where the performance date has passed
Where the performance of the service has begun with the Buyer's consent
In services whose prices fluctuate depending on financial market conditions
7.4. Refund Upon Withdrawal
If the right of withdrawal is properly exercised, the Seller shall refund the total amount to the Buyer using the same payment method within 14 (fourteen) days at the latest from the date the withdrawal notice reaches the Seller.
8. Cancellation and Refund Conditions
8.1. For cancellations made a certain period before the service performance date, the current cancellation policy published on yatveteknem.com shall apply.
8.2. In cases where the service cannot be performed due to force majeure (natural disaster, epidemic, war, legal regulations, etc.), an alternative solution shall be offered by mutual agreement of the parties, or the paid amount shall be refunded.
8.3. Refund transactions are subject to bank and credit card refund procedures depending on the payment method. The time for the relevant amount to be reflected in the Buyer's account after the Seller initiates the refund is entirely dependent on the bank.
9. Default and Legal Consequences
If the Buyer defaults on credit card payments, the Buyer acknowledges, declares, and undertakes that they will pay interest within the framework of the credit card agreement between the cardholder and the bank, and will be liable to the bank.
10. Competent Court
For disputes arising from this agreement, Consumer Arbitration Boards shall have jurisdiction up to the value announced by the Ministry of Customs and Trade, and Consumer Courts shall have jurisdiction for amounts exceeding this value. Consumer Arbitration Boards and Consumer Courts at the Seller's domicile or the Buyer's residence shall have jurisdiction.
11. Effective Date
This agreement takes effect on the date it is approved electronically by the Buyer. A copy of the agreement shall be sent to the Buyer's registered email address.
The Buyer declares that they have read, understood, and accepted all the terms of this Distance Sales Agreement.
